Failed sobriety tests lead to Wisconsin arrest

Most people in Wisconsin recognize the potential risks of driving under the influence. However, it may be easy to assume that a person who has made mistakes involving drunk driving in the past will repeat the same mistakes in the future, regardless of the changes they make in their lives. Unfortunately, one Wisconsin man was recently arrested after he allegedly failed sobriety tests.

Police say that the man was driving with a brake light that was inoperative at approximately 9:30 a.m. on a day in March. As a result, they say they conducted a stop. Officers claim that they could smell alcohol after the stop was initiated.

Police reports claim that the man admitted that he had consumed alcohol the night before. A field sobriety test was conducted, and the man was taken into custody. He is now facing his fourth operating while under the influence offense. Blood samples were taken, but the results of those tests are unclear.

Although police may rely on field sobriety tests to help make a determination whether an arrest is warranted, results may not be an accurate reflection of alcohol consumption. There are many factors -- often not taken into consideration -- that could affect the results of a field sobriety test, including illness, fatigue or stress caused by a traffic stop. Many people in Wisconsin feel unprepared to make the necessary decisions regarding criminal charges -- including whether and how to challenge the results of a field sobriety test -- prompting them to seek assistance from an attorney with experience with such cases.
