I cannot express in words the immense gratitude I have for what Sarvan was able to accomplish for me. This was my first OWI charge and, as someone that hadn’t even gotten a speeding ticket in their life, one of the most stressful/scariest moments of my life. JP was pulled over in his driveway for Speeding (65 MPH in a 30 MPH zone). Upon approaching the vehicle, JP denied drinking and then attempted to enter his residence. He was restrained and put in handcuffs. JP now explained that he did not have "much" to drink and refused the balancing field sobriety tests due to a back injury. He passed the alphabet and counting test and was then arrested. He refused the evidentiary test to check his blood-alcohol concentration. As a result, JP was charged with Operating a Motor Vehicle While Under the Influence-First Offense (OWI), Unlawfully Refusing a Chemical Test and Speeding. An additional citation for Operating Without Proof of Insurance was also thrown in.
By filing a formal legal challenge to an inaccuracy on the form created to advise individuals of the consequences for refusal an evidentiary chemical test, Attorney Murray was able to gain leverage for negotiations and work out an agreement whereby the OWI was amended to a non-alcohol related citation for Reckless Driving. The citation for Speeding was amended to a non-moving equipment violation for Defective Speedometer and the Refusal charge along with the insurance citation were completely dismissed. This was a great result and JP was happy to accept the offer.

The outstanding outcome in WL's** case was no easy feat. WL had been arrested in a county notorious for not plea bargaining drunk driving charges. And for nearly two years, the prosecutor in WL's case refused to budge. A good portion of this time was spent litigating whether WL would be entitled to a jury trial. You see, in a first offense case, a jury trial has to be demanded (and paid for) within a short time of the first court appearance. Here, WL did not hire Dennis Melowski until that time had already passed. Dennis knew that WL had a very good set of facts for a jury, but his prospects of winning before a judge would be slim, as the vast majority of judges end up siding with the police in these cases. But Dennis refused to give up fighting for WL's right to a trial by jury... and left no stone unturned in the process. Dennis obtained a transcript of WL's first court appearance and discovered that the judge did not properly advise WL of the deadline for requesting a jury trial. Dennis filed a motion to allow a jury trial because of this defect. The prosecutor objected and filed his own motion in opposition. After multiple hearings, the judge agreed with Dennis. WL was permitted to have a jury trial. But the prosecutor still would not budge. During the next 6 months the case was prepared by both sides for trial. Finally, just two days before the trial was supposed to begin, Dennis was able to convince the prosecutor that a conviction at trial on the drunk driving charges was in serious doubt. Rather than risk losing at trial to Dennis, the prosecutor agreed to a very favorable deal. The drunk driving charges were dropped. In exchange, WL agreed to plead no contest to the minor traffic offenses of Inattentive Driving and Driving Too Fast for Conditions. Besides fines, WL suffered no other penalties. Because he avoided a drunk driving conviction, WL's job was saved. Needless to say, WL could not be happier.

Case AmendedBAC First Offense Amended to Reckless Driving
CW was traveling on a motorcycle when his brother, who was on a bike in front of him, wiped out. CW called for an ambulance and despite his good intentions, ended up being arrested for OWI after allegedly failing the field sobriety tests. The allegations were six of six clues on the HGN test, three of eight on the Walk-And-Turn, and three of four on the One Leg Stand test. A preliminary breath test resulted in a .147 result and an evidentiary chemical test of CW's breath, the report was. 13. Attorney Murray filed various motions challenging the evidence in CW's case and the prosecutor ultimately agreed to a resolution whereby the OWI would be amended to a Reckless Driving citation.
Charge ReducedBoating While Intoxicated
SL, a commercial pilot, was arrested for Boating While Intoxicated when the DNR stopped his boat for a lighting violation. After the breath test returned a result of .12, SL was issued another charge of Operating a Boat with a Prohibited Alcohol Concentration. As you can imagine, any alcohol related offense to a commercial pilot could mean the end of his career. With so much at stake, SL hired Melowski & Singh and Attorney Matt Murray went to work raising various legal issues on SL's behalf, including a novel legal challenge to the implied consent procedure used in Boating While Intoxicated cases. This challenge was particularly helpful as it had the potential to change the process for all Boating While Intoxicated cases in Wisconsin. As the motion hearing approached, Attorney Murray successfully negotiated a resolution wherein SL pled to two minor boating citations: Failure to Yield - Boating Violation and Lighting Equipment Violation. SL could not be happier.

JP was on a pontoon boat with his family when the boat was stopped by DNR wardens for having blue lights illuminated across the side of the boat at night, which is a violation of the law. They instructed JP to turn off the ignition as he was operating the boat. The wardens then boarded the vessel. They allegedly observed the odor of intoxicants coming from JP's breath and JP admitted to consuming two, three or four beers. JP was then run through field sobriety tests, which he allegedly failed and was arrested for Boating While Intoxicated.
Attorney Murray focused the attack on the field sobriety tests. The typical roadside field sobriety tests related to balance cannot be performed on a boat. For this reason, the wardens administered the Horizontal Gaze Nystgamus (HGN) test, which had problems with its administration, a finger to nose test, a palm pat test, and a hand coordination test. The problem with these tests (aside from the HGN) is that they are not standardized and supported by the studies the way roadside field sobriety test are. Knowing this, Attorney Murray challenged the relevancy of the supposed "failed" tests to the issue of intoxication and asked the judge to keep out this evidence.
The judge never issued a decision because the prosecution offered to resolve the case with citations for speeding and a lighting violation prior to the motion hearing, which JP gladly accepted.

Since 1999, MK has been the owner/operator of a small trucking business that transports oversized machinery nationwide. It's a very successful business, but one that depends entirely on MK possessing valid CDL privileges at all times. As everyone in MK's field knows, a drunk driving conviction is like a professional death sentence, as a conviction on such a charge results in immediate CDL disqualification and skyrocketing insurance rates. So when MK picked up his first-ever drunk driving charge, he had to fight it. His livelihood was directly at stake. Fortunately, MK was referred to Dennis Melowski by a former client whose trucking career Dennis had saved a few years before. Dennis knew the first order of business was to obtain a stay of MK's administrative suspension, which was set to take effect just 30 days after MK's arrest. After a contentious hearing in which the prosecutor vehemently objected to the requested stay, Dennis was able to persuade the judge to side in his favor. This meant that MK would be able to maintain fully valid privileges while Dennis fought the case in court. As it turned out, this was just the first of many victories in MK's defense. After several months of investigation and hearings, Dennis was ultimately able to convince the prosecutor that there were sufficient problems in the case to warrant the original charges being dropped. Dennis was able to negotiate an incredible outcome. MK would plead no contest to two citations for Improper Parking Off Roadway, an offense that is so minor that it carries zero points. Aside from paying fines, MK suffered no consequences from his arrest. He never lost his license for a single day and his trucking business continues to thrive.
