Man accused of drunk driving faces charges in Wisconsin

A man accused of killing a pedestrian while he was drunk behind the wheel is facing serious charges, according to local sources. The accident took place in Algoma on Aug. 12, and the man was apprehended the same day. He now faces a count of hit and run resulting in death. It is unknown if he will be separately charged with drunk driving. 

According to the report, the 44-year-old man was apparently driving back from a bar in Oshkosh, Wisconsin, with his wife when he reportedly struck a pedestrian at the corner of Mayberry Manor and Witzel Avenue. The pedestrian, who has not been named by police pending next-of-kin, was pronounced dead at the scene. The driver apparently then fled the scene, driving his vehicle home. 

He was apprehended a short time later after damage was noticed on the front end of his vehicle. He reportedly told police he thought he had hit a deer. He also submitted to a field sobriety test as well as a preliminary breath test. This test apparently registered a .091 blood alcohol level, elevated above the state's legal limit of .08. It is unclear whether he remains in police custody at this time or if he has been released. 

Drunk driving accidents are particularly tragic due to their preventability. However, it will be up to Wisconsin prosecutors that drunk driving did predicate this accident. The man's defense attorney will attempt to build a compelling defense against the charges using a variety of legal tactics and strategies appropriate to this particular case.
